1. Parties and Scope

These Terms of Use ("Agreement") are concluded between Tabbyte Teknoloji ve Danışmanlık Limited Şirketi ("e9e", "Platform", "we") and the natural or legal person ("User", "you") who uses the e9e.io website and/or mobile applications.

By using the platform or creating an account, you declare that you have read, understood and accepted this Agreement.

2. Description of Service

e9e is a SaaS (Software as a Service) platform that offers the following services:

• AI-powered prospect (lead) finding and management
• Email marketing automation
• LinkedIn and other social media integrations
• CRM (Customer Relationship Management) tools
• Analytics and reporting
• AI-powered communication tools
• Collecting and enriching prospect (lead) data from publicly available sources (search engines, business directories, mapping services, professional networks, social media platforms)
• Data enrichment through third-party data providers and API services
• Lead discovery using web scraping and automated data collection technologies

3. Account Creation and Security

3.1. Account Requirements

• You must be over 18 years old
• You must provide accurate and up-to-date information
• For company accounts, you must be an authorized representative
• You must have a single active account

3.2. Account Security

• It is your responsibility to keep your password confidential
• You are responsible for all activity on your account
• Notify us immediately in case of suspicious activity
• We recommend that you use a strong password

4. Usage Rules

4.1. Acceptable Use

You may use the platform only for lawful business purposes. You undertake to:

• Comply with all laws and regulations
• Respect the rights of third parties
• Not send spam or unsolicited communications
• Not jeopardize platform security

4.2. Prohibited Uses

The following uses are strictly prohibited:

• Use for illegal activities
• Distribution of spam, phishing or malicious content
• Hacking or reverse engineering the platform
• Creating fake accounts
• Harassing other users
• Spreading viruses or malware
• Causing the platform to be overloaded
• Attempting unauthorized data collection, reverse engineering or automated access to the e9e platform or its infrastructure
• Committing copyright infringement

4.3. Lead Data Use Responsibilities

Regarding the prospect (lead) data you obtain through the platform:

• You are obligated to use all lead data in compliance with applicable data protection legislation (KVKK, GDPR, CAN-SPAM, PECR and other relevant regulations).
• You may use lead data only for legitimate commercial communication purposes.
• You may not sell, rent or share lead data with third parties in an unauthorized manner.
• You are obligated to promptly fulfill data deletion, access or objection requests from the data subjects concerned.
• Sending bulk spam, unsolicited commercial communications or harassing messages is strictly prohibited.
• In communications you carry out based on lead data, you must immediately end the communication if the recipient indicates they are not interested.
• All legal responsibility arising from the use of lead data obtained through the platform belongs to you.
• e9e does not guarantee the accuracy, currency or completeness of lead data.

5. Pricing and Payment

5.1. Plans and Pricing

• Current prices are published on our website
• Prices are exclusive of VAT (unless otherwise stated)
• Price changes are notified in advance

5.2. Payment Terms

• Payments are collected in advance
• An automatic renewal feature is available
• Accepted payment methods: Credit card, bank transfer
• Service may be suspended for late payments

5.3. Refund Policy

• Full refund right within the first 14 days (for annual plans)
• No refunds for monthly plans
• Pro-rata refund for partial month usage

6. Intellectual Property

6.1. Platform Rights

The e9e platform, its logos, software, design and content are the property of e9e and are protected by copyright, trademark and other intellectual property laws.

6.2. User Content

You own the content (data, files, messages) you upload to the platform. However, you grant us a limited license so that we can provide the services.

7. Privacy

The collection and processing of your personal data is subject to our Privacy Policy (/tr/legal/privacy-policy). By using the platform, you accept this policy.

8. Limitations of Liability

8.1. Service Warranty

The platform is provided "as is". We do not guarantee uninterrupted or error-free operation. Despite reasonable efforts, we are not responsible for the following:

• Technical malfunctions and outages
• Issues in third-party services
• Data loss (backup is your responsibility)
• Indirect damages, loss of profit

8.2. Lead Data Disclaimer

e9e does not guarantee the accuracy, currency or legality of lead data collected from publicly available sources. Lead data is compiled from publicly available information and may be affected by changes in third-party sources. The user agrees to use lead data at their own responsibility and in compliance with the relevant legislation.

8.3. Liability Cap

In the event of any claim, our total liability is limited to the total amount you have paid over the last 12 months.

9. Termination

9.1. By You

• You can close your account at any time
• You can delete your account from the Settings section
• You can export your data before deletion

9.2. By Us

We may suspend or close your account in the following cases:

• Breach of this agreement
• Non-payment
• Illegal activities
• Behavior that threatens platform security

10. Changes

We may change this agreement with prior notice. For significant changes, you will be notified by email 30 days in advance. Continuing to use the platform after the changes means you accept the new terms.

11. Dispute Resolution

Disputes arising from this agreement are subject to the laws of the United Kingdom. The Courts of London have jurisdiction over disputes.

12. General Provisions

• Severability: The invalidity of one provision does not affect the others
• Waiver: Failure to exercise a right does not constitute a waiver
• Assignment: You may not assign your rights without our consent
• Entirety: This agreement represents the entire agreement between the parties
