1. Parties and Scope
These Terms of Service ("Agreement") are entered into between Tabbyte Teknoloji ve Danışmanlık Limited Şirketi ("e9e", "Platform", "we") and the individual or entity using the e9e.io website and/or mobile applications ("User", "you").
By using the Platform or creating an account, you acknowledge that you have read, understood, and agree to this Agreement.

- Data enrichment through third-party data providers and API services
- Lead discovery using web scraping and automated data collection technologies
3. Account Creation and Security
3.1. Account Requirements
- You must be at least 18 years old
- You must provide accurate and current information
- For business accounts, you must be an authorized representative
- You may only have one active account
3.2. Account Security
- Keeping your password confidential is your responsibility
- You are responsible for all activities under your account
- Report suspicious activity to us immediately
- We recommend using a strong password
4. Usage Rules
4.1. Acceptable Use
You may only use the Platform for lawful business purposes. You agree to:
- Comply with all laws and regulations
- Respect third-party rights
- Not send spam or unwanted communications
- Not compromise platform security
4.2. Prohibited Uses
The following uses are strictly prohibited:

- Distribution of spam, phishing, or malicious content

4.3. Lead Data Usage Responsibilities
Regarding lead data obtained through the Platform:
- You are responsible for using all lead data in compliance with applicable data protection regulations (KVKK, GDPR, CAN-SPAM, PECR, and other relevant laws).
- Lead data may only be used for legitimate business communication purposes.
- You may not sell, rent, or share lead data with unauthorized third parties.
- You must promptly fulfill data deletion, access, or objection requests from data subjects.
- Bulk spam, unsolicited commercial communications, or harassing messages are strictly prohibited.
- If a contact indicates they are not interested, you must immediately cease communication.
- You bear full legal responsibility for the use of lead data obtained through the Platform.
- e9e does not guarantee the accuracy, currency, or completeness of lead data.
5. Pricing and Payment
5.1. Plans and Pricing
- Current prices are published on our website
- Prices exclude VAT (unless otherwise stated)
- Price changes will be notified in advance
5.2. Payment Terms
- Payments are collected in advance
- Auto-renewal feature is available
- Accepted payment methods: Credit card, bank transfer
- Service may be suspended for late payments
5.3. Refund Policy
- Full refund within first 14 days (for annual plans)
- No refunds for monthly plans
- Pro-rata refund for partial month usage
6. Intellectual Property
6.1. Platform Rights
The e9e platform, logos, software, design, and content are owned by e9e and protected by copyright, trademark, and other intellectual property laws.
6.2. User Content
You retain ownership of content you upload to the platform (data, files, messages). However, you grant us a limited license to provide our services.
7. Privacy
The collection and processing of your personal data is governed by our Privacy Policy. By using the Platform, you accept this policy.
8. Limitation of Liability
8.1. Service Warranty
The Platform is provided "as is". We do not guarantee uninterrupted or error-free operation. Despite reasonable efforts, we are not liable for:

- Issues with third-party services
- Data loss (backup is your responsibility)
- Indirect damages, loss of profits
8.2. Lead Data Disclaimer
e9e does not guarantee the accuracy, currency, or legality of lead data collected from publicly available sources. Lead data is compiled from public information and may be affected by changes in third-party sources. The User agrees to use lead data at their own responsibility and in compliance with applicable laws.
8.3. Liability Cap
In any claim, our total liability is limited to the total amount you paid in the last 12 months.
9. Termination
9.1. By You
- You can close your account at any time
- Account deletion is available in Settings
- You can export your data before deletion
9.2. By Us
We may suspend or terminate your account in the following cases:
- Violation of this agreement
- Non-payment
- Illegal activities
- Behavior threatening platform security
10. Changes
We may modify this agreement with prior notice. For significant changes, you will be notified 30 days in advance via email. Continuing to use the platform after changes means you accept the new terms.
11. Dispute Resolution
Disputes arising from this agreement are subject to the laws of the United Kingdom. London Courts have jurisdiction over disputes.
12. General Provisions
- Severability: Invalidity of one provision does not affect others
- Waiver: Not exercising a right does not constitute waiver
- Assignment: You cannot transfer your rights without our consent
- Entirety: This agreement represents the complete understanding between parties
